Terms and Conditions Overview

The following points outline our terms and conditions:

  • Company Name: Statham Custom Cabins (hereinafter referred to as "The Company").

  • Registered Office: Tower House, The Street, Kingscourt, Stroud, GL55DN.

Whenever we refer to "Statham Custom Cabins" or use the pronouns we, our, or us, we are referring to Statham Custom Cabins, unless stated otherwise.Additionally, whenever you see the term our site, it refers specifically to www.stathamcustomcabins.co.uk.

RETAIL - TERMS AND CONDITIONS

1.1 Overview

 

At Statham Custom Cabins, we want to ensure that your purchasing experience is well-informed and satisfactory.

 

The following terms detail our commitment to delivering our products, the procedures to follow in case of any issues, our returns policy, and other essential information.

 

We encourage you to read through these terms carefully to ensure you are comfortable and confident with the conditions you are agreeing to before making a purchase. If you have any questions or need clarification, please do not hesitate to reach out to us via email.

In the event that we need to reach you, we will do so via the email address you provided when you submitted your enquiry or placed your order.

 

Note: Throughout these terms, references to "writing" or "written" pertain solely to communication via email. We will not send correspondence to your postal address.

1.2 Placing an Order

At Statham Custom Cabins, we specialise in providing bespoke services for our products. As each item is crafted by us, we can accommodate custom sizes and styles. However, please note that there may be occasions where we cannot fulfil specific bespoke requests.

 

Upon raising an enquiry, a no-obligation consultation may be conducted either verbally or face-to-face. Following this, a concept design will be sent to you via email (please check your spam/junk folder). We will collaborate with you until you approve the concept design. Please be aware that the concept design is a preliminary representation intended to provide an impression of how the final build may appear based on your requirements; it is not a definitive, detailed design.

 

Once you agree to the concept design and indicate your desire to proceed, we will need your confirmation in writing, which also signifies your acceptance of these terms and conditions. At this point, we will explain and agree upon the payment structure.

 

An invoice will be issued via email, and payments can be made through bank transfer (BACS) or directly on our website. All transactions will be processed in Pounds Sterling.

 

Our acceptance of your order will be confirmed through an email, at which point a contract will be established between you and Statham Custom Cabins.

 

Please note that due to the bespoke nature of our products, returns are only accepted for items that are faulty or do not match the description or specifications agreed upon at the time of purchase. If your order is found to be faulty in any way, please contact us immediately.

Payment Structure:

  1. Once you have had your free, no-obligation consultation and concept design, and you are happy to proceed, you will need to secure your next available booking slot with a £500 deposit.

  2. A minimum 40% down payment is required at least 4 weeks before the commencement of building work.

  3. Once the framing structure is up,  a 40% interim payment is due to continue the project smoothly.

  4. The remaining 20% final payment is due upon the successful completion of your project.

1.3 Changes

i. Your Changes

 

If you wish to make a change to the item or product you have ordered, please contact us within 24 hours of placing your order. We cannot guarantee that changes will be accommodated.

 

If the requested change is possible, we shall inform you of any alterations to the price of the item or product, the timing of delivery, or any other necessary adjustments resulting from your request.

 

We will then ask you to confirm whether you wish to proceed with the changes or continue with the original order.

 

ii. Our Changes

 

We may change an item or product to reflect updates in relevant laws and regulatory requirements, or we may make minor adjustments and improvements.

 

In the case of more significant changes to an item or product, or to the price of an item or product, we will notify you accordingly.

 

You will then have the option to contact us to confirm your decision not to proceed with your order.

 

If you choose not to go ahead, you will receive a refund for any item or product you have paid for but not received.

1.4 Cancellations

Due to the nature of our products, all items are either made to order or personalised. Therefore, if you would like to cancel your order, please do so within the first 24 hours of placing your order.

1.5 Delivery

Leading up to and during the build, deliveries will arrive at your build site.

 

If you instruct us to leave your delivery in a safe place or with a neighbour, the responsibility for the safety of your parcel lies with you. If our delivery of your product is delayed due to an event outside our control, we will contact you as soon as possible to inform you and will take reasonable steps to minimise the delay. We will not be liable for delays caused by events outside of our control. A product will be your responsibility from the time it is delivered to the address you provided, and you will own that product once we have received full payment. If there is any damage during transit, please inform us within 24 hours of receiving your item, including pictures. This will enable us to raise the issue with the delivery courier promptly for the claim.

Responsibility

Once one of our products becomes your own, the care of it is your responsibility, and you should be mindful of its materials. Therefore, we cannot be held liable for any faults that may arise in your piece if it is cared for in an unsuitable manner. If you need advice, you are always welcome to consult with us. By purchasing from us, you undertake that all products ordered are for your own use and not for resale.

Appreciating Natural Materials

At Statham Custom Cabins, we take pride in creating beautiful pieces from high-quality wood. Please note that the grain and appearance of the wood will always vary from one piece to another, so your item will never look exactly the same as anyone else’s. The product you receive may also differ slightly from the items depicted in our pictures. However, every single item will be crafted in the same way from start to finish, ensuring it is always beautiful, bespoke, stylish, and long-lasting.

1.6 Returns & Exchanges

Due to the nature of our products, all items are either made to order or personalised. Returns and exchanges are not accepted for this reason.

2.1 A Summary

Everything included on this page explains the terms surrounding your use of our website. It is wise to familiarise yourself with them before browsing with us. Remember, we remain available via email should you wish for us to explain any points in more detail.

2.2 Reliance of Information

While we strive to keep our website up to date, we operate on an ‘as is’ basis. This means that all information, commentary, and materials posted are intended for general information purposes only. Therefore, we accept no liability for any damage, costs, injury, or financial loss resulting from reliance placed on such information by any visitor to our website.

2.3 Accessing the Statham Custom Cabins Website

We will always try to keep our website accessible, but if we need to withdraw your access or decide to suspend or close our website, we reserve the right to do so without any liability. It is your responsibility to ensure you have the necessary measures to reach our website, such as internet access. Additionally, ensure that anyone using your internet connection is aware of our terms of use.

2.4 Intellectual Property Rights

All copyright, trademarks, and other intellectual property rights in all logos, designs, text, images, and materials on our website are owned by us. No one should copy, adapt, exploit, or use any of that content without our permission, except for downloading and temporarily storing our webpages for personal use.

2.5 Linking To and From our Website

We may include hyperlinks to other websites. By agreeing to our terms, you accept that you won’t frame our website on any other site or create hyper- or deep links without our written consent. If you click links to third-party websites, you leave our site, and we are not responsible for the content or any issues that may arise from those sites.

2.6 Our Liability

While we do our best to ensure the accuracy of our website, we cannot guarantee it will be error-free or always up to date. We regularly update our content. Therefore, these terms exclude all conditions, warranties, and other terms implied by law, and we will not be liable for any direct, indirect, or consequential loss or damage related to our website, including but not limited to loss of business, income, profits, data, or goodwill.

2.7 What’s Deemed as ‘Acceptable Use’ & Website Security

We do not tolerate actions that could damage our reputation or the integrity of our website. This includes introducing viruses or malicious material. Unacceptable use also includes gaining unauthorized access to our website or connected servers. We will not be liable for any loss or damage caused by attacks or harmful materials.

2.8 Uploading Material to our Website

Any material you upload to our website is considered non-confidential and non-proprietary. We have the right to use, copy, distribute, and disclose it to third parties. We may also disclose your identity if material you upload violates someone else's rights. We reserve the right to remove any material you post at any time.

2.9 Privacy & Cookies

Any personal details collected will only be used as explained in our Privacy Policy. By using our website, you consent to the processing of your information. We also use cookies, and you can review our separate Cookie Policy for more details.

2.10 Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, it shall be deemed not to form part of these terms, and the validity of the remaining provisions will not be affected.

2.11 Variations

We can revise any of the terms on this page at any time, so it is your responsibility to check for updates periodically.

2.12 Jurisdiction & Applicable Law

These terms are governed by and construed in accordance with the law of England and Wales and are subject to the exclusive jurisdiction of the English courts.

3. Custom Cabin and Garden Rooms - TERMS AND CONDITIONS

3.1. Application of These Terms and Conditions

3.1.1. By agreeing to proceed with Statham Custom Cabins, the customer is deemed to have accepted these terms and conditions. It is the customer’s responsibility to obtain a copy of these terms for their reference.


3.1.2. Statham Custom Cabins reserves the right to amend these terms and conditions at any time.


3.1.4. Variations to these terms and conditions will only be valid if agreed upon in writing by the company.


3.1.5. If any part of this agreement is deemed unenforceable or invalid, the remainder will remain valid and enforceable.


3.1.6. This contract is governed by English law, and any disputes will be referred to the English courts.

3.2. Our Products

3.2.1. The company website and any elevation drawings are for guidance only and do not form part of any contract.


3.2.2. While the company strives for accuracy, exact measurements on the website or order documentation are subject to reasonable tolerances.


3.2.3. The company reserves the right to alter specifications without prior notice. Reasons may include improving quality, material unavailability, or significant changes in material costs. Customers will be informed of significant changes.


3.2.4. Aesthetic improvements to goods and materials may be made by the manufacturer. These changes will not affect the product’s use and do not constitute a breach of agreement.

3.3. Pricing

3.3.1. All prices include VAT at the current rate.


3.3.2. Statham Custom Cabins adheres to a transparent pricing policy. Discounts are only applied if advertised on the website at the time of order.


3.3.3. Once an order is placed and the deposit is received, the price is fixed unless the order is on hold for more than 90 days.


3.3.4. If changes to the project are requested after the deposit is paid, customers must

contact info@stathamcustomcabins.co.uk. If changes are possible, the company will inform the customer of any price adjustments, timing changes, or other necessary modifications. Major changes incur a £500 (plus VAT) project management fee, plus material and labour costs. Additional costs must be paid in full before further work begins. Delayed payments may result in project delays, for which the company is not liable.

3.4. Payments

3.4.1. A £500 deposit is required when placing an order.


3.4.2. A minimum 40% down payment is required at least 4 weeks before the commencement of building work.. Title of goods remains with Statham Custom Cabins until all payments are received.


3.4.3. The final 20% payment is due on the final day of installation.


3.4.4. If remedial work is required after installation, a proportionate retention (reflecting the cost of outstanding work) will be agreed upon until the work is completed.


3.4.5. Final payments must be made via bank transfer to the bank details provided in the sales agreement/order confirmation.


3.4.6. Refer a Friend Scheme: Customers who refer a friend or family member (not already in contact with the company) will receive a £100 Amazon voucher after the referred project is completed. The referred individual will also receive £100 off their final invoice. This scheme is unlimited.

3.5. Cancellations

3.5.1. As all garden rooms are made-to-order, they are exempt from cancellation rights.


3.5.2. If an order is cancelled after the base/ground screws are installed, the customer forfeits the total sales price unless an alternative agreement is reached.


3.5.3. The company reserves the right to cancel an order at any time. If this occurs, the customer will receive a full refund.


3.5.4. If the agreed installation date is cancelled less than 48 hours before installation, cancellation penalties will apply to cover transport, warehouse, labour, and administrative costs.

3.6. Orders on Hold

3.6.1. Customers may place their order on hold if they are not ready to proceed with installation. The holding deposit will remain on account, and prices will remain fixed for 30 days. After this period, any price updates will apply.


3.6.2. Orders can remain on hold for up to 12 months before being automatically cancelled. Customers will be contacted to arrange a refund of the holding deposit.

3.7. Planning Permission

3.7.1. Planning consent is typically not required, but it is the customer’s responsibility to confirm this with their local planning authority. Statham Custom Cabins is not liable for breaches of Permitted Development/Planning regulations.


3.7.2. For properties in Conservation Areas, customers should confirm with their local authority whether Article 4 Directions (restrictions on Permitted Development rights) apply.


3.7.3. Customers are responsible for ensuring their building and its location comply with Planning Approval conditions. Statham Custom Cabins is not liable for changes made to the design, specification, or location of a building after a Planning Application is submitted or approved.

3.8. Scheduled Dates

3.8.1. The company will always strive to honour the estimated delivery/installation date. However, we cannot guarantee the installation date and cannot be held responsible for delays outside of our control, including but not limited to extreme weather conditions, access difficulties, parking, or traffic. We will keep you informed of any potential delays and rearrange for the earliest possible date.


3.8.2. The company is not liable for any loss, damages, charges, or expenses incurred by the customer as a direct or indirect result of delays in delivery, installation, or completion of an order. The company will not be financially liable for return visits required for rectification works.


3.8.3. Any timeframes provided for installation duration are estimates only and do not form part of any contract. The company does not guarantee completion by a specific date or time.


3.8.4. If the customer postpones or delays the installation of the base or building within 7 calendar days of the scheduled installation date, the following penalties will apply:

  • 14-6 days before the scheduled base installation date: 15% of the total sales price.

  • 5 days before the scheduled base installation date: 30% of the total sales price.

  • After the base has been laid: 35% of the total sales price.

3.9. Work on Site

3.9.1. The customer is responsible for preparing the site.


3.9.2. The customer must provide parking permits, access, and permissions in advance of the base and building installation dates. Access to electricity and water is required on-site.


3.9.3. All sites/bases must be level with proper drainage and a clearance of no less than 600mm beyond the external dimensions of the building for construction.


3.9.4. Failure to complete necessary preparations may result in delays or cancellation of the installation schedule. Additional labour and transport costs will be charged to the customer if preparations are incomplete.


3.9.5. The company will not deliver or install products through domestic buildings, over fences, or other obstacles without prior consultation and written agreement.


3.9.6. Due to the size and weight of materials, some surface damage may occur to components of the garden building. The company will repair any damage as necessary.


3.9.7. While every effort is made to avoid damage to the customer’s property, Statham Custom Cabins cannot be held liable for unavoidable damage caused by the installation team, delivery companies, or others on-site.


3.9.8. Landscaping should be completed after the building installation to avoid incidental damage. The company is not liable for damage to landscaping.


3.9.9. Materials, fittings, or appliances supplied by the customer will be installed on a goodwill basis only. The company is not liable for damage to such items. Additional items will not be installed unless agreed in writing.


3.9.10. The company reserves the right to withdraw employees or contractors from a site deemed unsafe under Health and Safety Regulations. Work will resume once conditions are rectified.


3.9.11. Statham Custom Cabins is covered by liability insurance.


3.9.12. The site survey is a visual inspection only. The company is not liable for underground obstructions discovered during works.


3.9.13. The company reserves the right to cancel or postpone works due to unforeseen circumstances. If the company cancels the installation, a full refund will be provided unless the issue was caused by the customer or known to the customer beforehand.

3.10. Bases

3.10.1. The customer must be present on the base installation date to confirm the location. Once the base is constructed, the position cannot be changed.
3.10.2. No apertures or fittings for services not supplied by the company will be made unless agreed in writing.
3.10.3. If an existing base (e.g., concrete slab) is used, the company is not liable for subsidence or settlement issues.
3.10.4. Spoils created by the base team will not be removed unless agreed in writing before work begins.
3.10.5. The company is not liable for issues with building height if the customer has not levelled the site as per preparation notes.
3.10.6. The customer must provide geological surveys, architect drawings, or structural engineer reports at least 14 days before installation. If not provided, the company assumes the site is in perfect condition. Any issues arising later will invalidate the warranty.

3.11. Electrical Works


  1. Recommendation and Payment: Statham Custom Cabins may recommend and arrange for a third-party electrician to perform electrical work as part of the project. While we will facilitate payment to the electrician on behalf of the client, the electrician operates as an independent contractor and is not an employee, agent, or representative of Statham Custom Cabins.

  2. Liability Disclaimer: Statham Custom Cabins shall not be held liable for any issues, defects, delays, or damages arising from the work performed by the third-party electrician. Any disputes, claims, or concerns regarding the electrical work must be addressed directly between the client and the electrician.

  3. Client Acknowledgment: By agreeing to these terms, the client acknowledges and accepts that Statham Custom Cabins is not responsible for the quality, safety, or compliance of the electrical work performed by the third-party electrician.

   4. The company may assist with digging a trench for the cable, but the cable run is the responsibility of the customer and           electrician. The company is not liable for issues arising from this.


3.12. Your Guarantee

3.12.1. Statham Custom Cabins buildings are covered by a guarantee, which is activated from the date the final invoice is issued. The terms of the guarantee are as follows:

  • 5 years: Covers work carried out by the company during the installation of the building. This excludes normal wear and tear, decorated surfaces, or faults caused by manufacturers.

  • 1 year: Covers external fascias, internal linings and trim, floor coverings, internal accessories.

3.12.2. Buildings constructed under "Permitted Development" should not be used for habitable accommodation or dwelling. Doing so invalidates the guarantee.
3.12.3. Door adjustments are not covered under the guarantee and may occasionally be required. Customers can contact Head Office for advice on making adjustments.
3.12.4. Warping of timber fascia boards is not covered under the guarantee, as timber is a natural material and warping may occur.
3.12.5. Superficial cracking of timber cladding or fascia boards is not covered under the guarantee.
3.12.6. For window and door-related guarantees, customers should contact the glazing suppliers directly. The company can assist via info@stathamcustomcabins.co.uk if needed.
3.12.7. Underfloor heating warranties require that all furniture is raised on legs. The use of flat-based furniture will invalidate the guarantee.
3.12.8. Guarantee claims should be submitted to info@stathamcustomcabins.co.uk immediately upon discovering a fault. Delayed reporting may invalidate the guarantee. The company will remedy agreed issues free of charge but will not reimburse payments made to third-party repair contractors without prior written consent.
3.12.9. Faults caused by the customer will result in costs for remedial works being charged to the customer.
3.12.10. No guarantee is provided for materials, appliances, or services supplied by the customer and installed by Statham Custom Cabins. Such items are installed on a goodwill basis only.
3.12.11. The company's liability will not exceed the total purchase value of the product. Rectification of issues will fully discharge the company's liability under this warranty.
3.12.12. The company is not liable for subsidence to the garden room or surrounding installation site unless caused by negligence during installation.
3.12.13. Any alterations made to the building by the customer or a third party during construction will invalidate the guarantee. Related remedial works will be chargeable.

3.13. Plastering

3.13.1. Statham Custom Cabins does not offer plastering services but may recommend a local plasterer if available. The company is not liable for any work carried out by third-party plasterers.

3.14. Ventilation

3.14.1. It is strongly advised that all buildings include at least one opening window for ventilation purposes.


3.14.2. If the building is used as a gym or exercise room, good ventilation is crucial. The building should be heated and ventilated before and during use to prevent condensation on equipment.

3.15. Ground, Gutter, and Roof Maintenance

3.15.1. Statham Custom Cabins products require minimal maintenance, but customers must ensure areas around the building are kept clear. An air gap under the sides and rear of the building must be maintained to prevent vegetation or moisture intrusion.


3.15.2. Customers should treat timber cladding annually to maintain its quality. Contact info@stathamcustomcabins.co.uk for advice on suitable treatments.


3.15.3. Gutters and roofs must be inspected and cleared of debris at least twice a year.


3.15.4. Failure to maintain gutters and air gaps may result in damage to the building and invalidate the guarantee.


3.15.5. If remedial work is required due to the customer’s failure to maintain the building, associated costs will be charged to the customer.

3.16. Liability

3.16.1. Nothing in these terms excludes or limits the company's liability for death or personal injury caused by negligence or that of its employees or agents.If you have any questions about these terms, please contact us at info@stathamcustomcabins.co.uk, and we’ll be happy to assist.

4. Fire Safety Responsibilities

As a valued customer of Statham Custom Cabins, it is essential to prioritize safety within your custom-built cabin. It is the customer's responsibility to ensure that all fire safety measures are in place and compliant with local regulations and building requirements. This includes, but is not limited to, the installation of fire alarms, smoke detectors, and any other safety equipment deemed necessary by applicable building codes.

  • Customers must verify that fire safety measures are installed correctly.

  • Compliance with local fire safety regulations is mandatory.

  • Regular maintenance and testing of fire safety equipment are the customer's responsibility.

 

By adhering to these guidelines, you help ensure a safe environment for yourself and others within your custom cabin. 

5. Safety during the build stage.

At Statham Custom Cabins, we prioritise the safety of our customers and their families. It is the customer's responsibility to ensure that they and their families remain safe during the building stage of the cabin.

  • Customers must take necessary precautions to ensure safety around the build siter and around materials.

  • It is advised to keep children and pets away from the construction area to prevent accidents.

  • Customers should monitor the site for any potential hazards that may arise during the building process.

6. Permitted Development and Usage Responsibilities

At Statham Custom Cabins, all buildings are constructed under Permitted Development Rights, unless otherwise agreed upon and appropriate planning permissions have been arranged as per prior agreement. It is the customer's responsibility to ensure that the building is not used for purposes outside of what is allowed under Permitted Development regulations.Key Points:

  • Statham Custom Cabins will build under Permitted Development unless otherwise specified and agreed.

  • Customers must ensure that planning permissions, if required, are obtained and comply with local regulations.

  • The building must only be used for purposes allowed under Permitted Development Rights.

  • Misuse of the building outside of permitted uses may result in legal or regulatory consequences, which are the customer's responsibility.

By adhering to these terms, you help ensure compliance with all relevant regulations and avoid any potential issues.
